These Terms and Conditions (“Terms”) govern your use of the Cozydoro mobile application (“App”) operated by Torchingale (“we,” “our,” or “us”). By accessing or using Cozydoro, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you signify your agreement to these Terms. If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you and Torchingale.

You represent that you are legally capable of entering into this agreement under applicable law.

2. License and Scope of Use

Torchingale grants you a personal, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial productivity and time management purposes. You agree not to:

  • Copy, modify, or create derivative works of the App.
  • Reverse engineer or attempt to extract the source code of the App.
  • Use the App for any illegal or unauthorized purpose.
  • Interfere with service integrity, security, or availability.
  • Circumvent technical restrictions or access controls.

We may suspend or terminate access immediately if we reasonably believe you violated these Terms, applicable law, or platform rules.

3. User Accounts and Security

Cozydoro may provide account-based functionality through platform-level sign-in mechanisms. You are responsible for:

  • Providing accurate and complete account information.
  • Maintaining the security of your device and account credentials.
  • All activities that occur under your account. Torchingale is not liable for any loss or damage arising from your failure to protect your account information.

You must notify us promptly of suspected unauthorized account use.

4. Subscriptions and Financial Terms

Premium features within Cozydoro may require a paid subscription managed through authorized service providers.

  • Billing: Payments are processed by the relevant app distribution platform. Subscriptions may auto-renew unless cancelled before the renewal date according to platform rules.
  • Refunds: Since transactions are processed by external platform providers, refund handling is subject to the provider’s own policies.
  • Changes: We reserve the right to modify subscription fees at any time, with reasonable notice provided through the App or store listing.

We are not responsible for platform billing errors, payment failures, chargebacks, or delays caused by third-party providers.

5. Data and Analytics

We do not collect personal identity information through Cozydoro. The App may process limited technical and anonymous statistical data, including device/app context, aggregated usage counts, and diagnostics, solely to operate, analyze, and improve service quality.

To the extent permitted by law, your use of the App constitutes consent to this limited technical and analytics processing.

6. Intellectual Property Rights

All right, title, and interest in and to the App, including but not limited to the Torchingale name, logo (torch and bird hybrid), UI/UX design, minimalist aesthetics, and custom ambient sounds, are the exclusive property of Torchingale. These are protected by international copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, Torchingale disclaims all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the App will be uninterrupted, error-free, or completely secure.

No oral or written information provided by us creates any warranty not expressly stated in these Terms.

8. Limitation of Liability

IN NO EVENT SHALL TORCHINGALE OR ITS DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES resulting from your use or inability to use the App, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you for the subscription during the past six months.

To the maximum extent permitted by law, your exclusive remedy for dissatisfaction with the App is to stop using it.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

9. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Torchingale and its developer from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to your misuse of the App, breach of these Terms, violation of law, or infringement of third-party rights.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkiye. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Istanbul, Turkiye.

Before initiating formal legal proceedings, the parties should make a good-faith effort to resolve disputes by written notice within 30 days.

Any claim must be brought within one year of the event giving rise to the claim, unless a longer period is required by non-waivable law.

11. Changes to Terms

We reserve the right to update these Terms periodically to reflect changes in our service or legal obligations. Your continued use of the App following the posting of updated Terms constitutes your acceptance of those changes.

12. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Failure to enforce any provision is not a waiver of future enforcement.

These Terms constitute the entire agreement between you and Torchingale regarding the App and supersede prior understandings on the same subject.
